PARTICIPATION IN THOSE AREAS ONLY. PLEASE DO NOT PROCEED IF YOU ARE NOT A PERMANENT
LEGAL RESIDENT OF THE UNITED STATES. THIS SWEEPSTAKES SHALL BE CONSTRUED AND GOVERNED
ACCORDING TO THE LAWS OF THE U.S.
1. Eligibility: The Pixie Hollow Play Pack Sweepstakes ("Sweepstakes") is open only to permanent legal residents of the fifty (50) United States and the District of Columbia, who are physically located and residing therein and who are 13 years of age or older as of time of entry. Employees of Sponsor (defined below), The Walt Disney Company, their advertising or promotion agencies, those involved in the production, development, implementation or handling of this Sweepstakes, any agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, subsidiaries, affiliates, licensees, service providers, prize suppliers and fulfillment companies, any other person or entity associated with this Sweepstakes (collectively "Sweepstakes Entities") and/or members of their immediate families (spouses, children, siblings, parents) and/or persons living in the same household as such persons, whether or not related, are ineligible to enter this Sweepstakes.
2. Sweepstakes Description:This Sweepstakes begins at 12:01 a.m. Pacific Time ("PT") November 19, 2009 and ends at 11:59 p.m. PT December 10, 2009 ("Sweepstakes Period"). For purposes of this Sweepstakes, all times refer to Pacific Time ("PT").
How to Enter:You must be registered with Disney.com ("Web Site") to enter the Sweepstakes. Registration is free. If you are registered with Disney.com, you may enter the Sweepstakes by clicking on the Leaf Button on http://disney.go.com/index or by visiting http://pixiehollow.go.com/contests_home.html and entering your Account ID and Password and clicking on the "submit" button ("Entry"). If you are not registered with Disney.com you must complete and submit the Registration Form located in the link: "Not Registered?" Entries must be received by 11:59 a.m. PT December 10, 2009. Limit one (1) entry per person/email for the entire Sweepstakes Period. Entries in excess of the limits stated herein will be void and disqualified. Proof of delivery or receipt of an Entry will not be deemed by Sponsor as proof of entry. Normal Internet access and usage charges imposed by your online service will apply. Any attempted form of entry into this Sweepstakes other than as described herein is void. A participant is not a winner of any prize unless and until participant's eligibility has been verified in accordance with these Official Rules and participant has been notified by Sponsor that his/her winning status is official. All potential winners in this Sweepstakes are subject to verification by Sponsor/Sponsor's representatives whose decisions are final and binding in all matters related to the Promotion.
3. Prizes/Odds of Winning/Sweepstakes GRAND prize:
Twenty (20) GRAND PRIZES: each consisting of the following elements: one (1) Tinker Bell and the Lost Treasure DS game, one (1) Nintendo DSi™ system with a Fairy-themed skin, and one (1) One-Month Pixie Hollow Game Card (approximate retail value ["ARV"]: $225.88).
Total ARV of all prizes: $4,517.60. Limit one prize per person/Address. If the actual value of a prize is less than the stated ARV, the difference will not be awarded. Any depiction of prizes is for illustrative purposes only. Prizes are not redeemable for cash or transferable. No substitution allowed except, at Sponsor's sole discretion, a prize of equal or greater value may be substituted. Sponsor will not replace any lost or stolen prize. Prize elements may not be separated. All prizes will be awarded provided a sufficient number of eligible Entries are received and prizes validly claimed by February 2, 2010, after which no alternate winners will be selected, nor unclaimed prizes awarded.
4. Drawing and Notification of Winners: Potential Winners will be selected in a random drawing from among all eligible entries received during the Sweepstakes Period on or about February 2, 2010 ("Drawing Date") by Sweepstakes Sponsor.
On or about January 12, 2010 potential winners will be contacted via email ("Email Contact") in order to obtain their mailing addresses. Once mailing address is received, potential winners will not be sent any notification prior to shipping their prize. All legal responsibilities of a minor (as defined by state of primary residence) under the Rules will be assumed by a Parent; and a minor winner's prize will be awarded in the name of the Parent. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: [1] potential winner's failure to respond to Email Contact after 3 calendar days [2] the return of any notice or prize as undeliverable; [3] potential winner's failure to provide Sponsor with satisfactory proof of age, identity and residency potential prize winner's failure to claim any prize within four (4) days after it is sent; [4] potential winner's failure to validly claim any prize by February 2, 2010 and [5] any other non-compliance with Rules. All prizes for qualified winners will be delivered on or before February 16, 2010. In the event of any prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner. All taxes are solely the responsibility of each winner.
5. General Conditions: Sweepstakes is subject to these Official Rules and all federal, state, and local laws (collectively "Rules and Laws"). Any personal information supplied by entrants to Sponsor or its affiliates will be subject to Sponsor's Privacy Policy. Thus, except where prohibited by law and Sponsor's Privacy Policy entry and/or Winner's acceptance of a prize constitutes permission for the Sweepstakes Entities to use Winner's name, address (city and state), photo, likeness, biographical information, statement and voice for advertising/publicity/trade purposes worldwide and in all forms of media (including posting on web site), in perpetuity, without further notice to or compensation in connection with said Sweepstakes or the prize awarded. Any person attempting to defraud or tamper with this Sweepstakes will be prosecuted and is not eligible for a prize. Use of any automated system to participate in this Sweepstakes or to attempt to participate is prohibited and will result in disqualification. If Sponsor suspects that any entrant is using an automated system, such entrant will be removed/barred from the Sweepstakes Web Site, will be disqualified and will be ineligible to receive a prize in this Sweepstakes. Any person attempting to use an automated system or attempting to forge or tamper with Sweepstakes or otherwise defraud Sponsor may also be prosecuted to the full extent of the law and will be ineligible for a prize. Entrants agree that the Sweepstakes Entities are not responsible for entrant's inability to access Sweepstakes via the Internet or to complete entry due to hardware or software compatibility problems, unauthorized intervention, server problems, delay caused by the volume of user traffic to the Sweepstakes Web Site and/or for any other reason. The Sponsor's Sweepstakes computer is the official time keeping device for the Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as originally planned, Sponsor at its sole discretion, reserves the right to cancel, suspend or modify the Sweepstakes or any portion thereof and conduct the drawing from among all salvageable eligible Entries received, if any, in a manner determined by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules.
6. Disclaimers: Sweepstakes Entities are not responsible or liable for Entries that are entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), or for entries that are illegible, late, destroyed, lost, misplaced, stolen, misdirected, tampered with, incomplete, deleted, damaged or otherwise not in compliance with these Official Rules and all such Entries will be disqualified. By entering Sweepstakes, each entrant agrees and acknowledges to be bound by the Rules and Laws, as well as the decisions of Sponsor which are final and binding in all respects; to waive any rights to claim ambiguity with the Rules and Laws, and that Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in this Sweepstakes; typographical errors in Sweepstakes promotional materials; use/misuse of a prize due to reasons beyond control of Sponsor and/or Sweepstakes Entities; human error; incorrect or inaccurate transcription of Entry Information; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or internet service provider utilized by Sweepstakes; interruption or inability to access Sweepstakes, Web Site, or any online service via the internet due to hardware or software compatibility problems; any damage to entrant's (or any third person's) computer and/or its contents related to or resulting from any part of Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, defects; and/or any other errors or malfunctions, even if caused by the negligence of one of the Sweepstakes Entities. Each entrant further agrees to indemnify and hold harmless Sweepstakes Entities from any and all liability resulting or arising from Sweepstakes, to release all rights to bring any claim, action or proceeding against Sweepstakes Entities, and hereby acknowledge that said Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize.
7. E-MAIL CHANGE OF ADDRESS POLICY: It is the sole responsibility of the entrant to notify Sponsor if the entrant changes his/her e-mail address or personal information. To do so, go to: www.Disney.com/youraccount and log into your account, click on the Account Details tab, update your e-mail address and click the Save Changes button.
8. Name of Winners or Rules Requests: For the names of the Winners or for an additional copy of these Official Rules, send a self-addressed, stamped envelope to: Pixie Hollow Hidden Leaf Sweepstakes, "RULES" or "NAMES OF WINNERS" (specify which), 500 South Buena Vista Street, Burbank, CA 91521-7691. All requests must be received by January 25, 2010.
