Eligibility: The Santa Paws 2: The Santa Pups Twitter Sweepstakes ("Sweepstakes") is only open to entrants, who at the time of entry are: (a) natural persons who are legal residents of, and currently living in, one of the 50 United States, the District of Columbia, Puerto Rico, or Canada (excluding Quebec); and (b) 13 years of age or older. Entrants must not be an employee or director, or IRS dependent, immediate family member or individual residing in the same household of, an employee or director, of Buena Vista Home Entertainment, Inc. ("BVHE"), Walt Disney Studios, their parent, and any subsidiaries, related and affiliated companies of each, Prize Logic, LLC, Disney Store USA, LLC, or their respective parent, subsidiary and affiliated companies, advertising, promotion, or production agencies, web masters and web suppliers. Void where prohibited by law and subject to all applicable federal, state, provincial, municipal, territorial, and local laws and regulations.
An entrant must have a non-private Twitter® account to participate in the Sweepstakes. If an entrant does not have a non-private Twitter account, there is no cost to create one at www.twitter.com. To participate in the Promotion, an entrant must agree to comply with the Twitter terms of use and privacy policy in order to create a Twitter account. There is no charge to follow @DisneySantaPaws on Twitter. If an entrant has a Twitter account and is not already a follower of @DisneySantaPaws, then an entrant may log onto Twitter using his/her Twitter user name and password, and then may become a follower of @DisneySantaPaws by going to https://twitter.com/DisneySantaPaws and clicking the "Follow" button.

Timing: Sweepstakes begins at 12:00:01 AM Pacific Time ("PT") on November 19, 2012 and ends 11:59:59 P.M. PT on December 10, 2012 ("Sweepstakes Period"). The Sponsor's computer is the Sweepstakes official clock.
Agreement to Official Rules: Participation in this Sweepstakes constitutes entrant's (and, if a minor, his/her parent's or legal guardian's) full and unconditional agreement to these Official Rules and Sponsor's and Administrator's decisions, which are final and binding in all matters related to this Sweepstakes. Being selected as the Grand Prize Winner in the Sweepstakes is contingent upon fulfilling all requirements set forth herein. These Official Rules form a binding legal agreement between the entrant and the Sponsor with respect to the Sweepstakes.
How to Enter: After becoming a follower of @DisneySantaPaws, during Sweepstakes Period, you must log on to your Twitter account, and Tweet a photograph of your dog to @DisneySantaPaws, including the hashtag #SantaPawsSweeps (an "Entry"). The Entry must contain the hashtag #SantaPawsSweeps in order to be a valid Entry. Entries must meet the Entry Guidelines as described in Section 7 below. Any Entries not complying with such Entry Guidelines, in Sponsor's sole and absolute discretion, will be considered ineligible and will not be part of the Sweepstakes. Limit one (1) Entry per person.
If it is discovered that an entrant has registered or attempted to register more than once in the Sweepstakes using multiple e-mail addresses, Twitter accounts, or multiple identities, all of that entrant's Entries will be declared null and void and any Prize he/she might have been entitled to receive will not be awarded.
NOTE: Due to the way Twitter operates its service, Sponsor may not receive Entries from Twitter users with "protected" updates (i.e., entrant has set his/her account so that only people the entrant has approved can view his/her updates). If an entrant tweets via SMS from his/her wireless phone, the entrant's wireless-service provider may charge the entrant for each text message sent and received. Entrants should consult their wireless-service provider regarding its pricing plans. Message and data rates may apply.
Entry Guidelines: Each Entry:
May not exceed 140 characters;
Must be entirely the original work of the entrant;
The photograph may not include any individuals other than the entrant;
May the photograph may only include a dog(s) that are owned by the entrant;
May not have not been published, or submitted in any other competition;
Must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, including copyright infringement, or legal or moral rights of any third party, living or deceased;
Must not disparage Sponsor, Administrator, or any other third party associated with the administration of the Sweepstakes (e.g., any person, product, location, retailer, company or brand).
Must not in any way contain or depict any identifiable brand names, trademarks or trade names;
Must not include any personally-identifiable information;
Must not contain material that is inappropriate, indecent, lewd, pornographic, cruel, obscene, hateful, tortious, defamatory, slanderous or libelous, or features gratuitous violence, dangerous stunts, real weapons of any kind, or drug use;
Must not contain material that promotes violence to any animals, harms or endangers any animal, bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;
Must not contain material that is unlawful, in violation of, or contrary to any laws or regulations; and
Must have been legally created (i.e., does not violate any laws or regulations in the creation of the photograph, including, but not limited to any animal cruelty laws).
General Conditions on Entry: Once submitted, all Entries become the exclusive property of Sponsor and will not be acknowledged or returned, nor will any correspondence be entered into with any entrant. Multiple entrants are not permitted to share the same e-mail address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different e-mail addresses, identities, registrations and logins, Twitter accounts, or any other methods will void entrant's entries and that entrant will be disqualified. Any use of any micro, robotic, automatic, programmed, or like entry methods will void all such entries affected by such methods and entrants using such methods will be disqualified. ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY SWEEPSTAKES RELATED WEBSITE(S) OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND IF SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.
Prize and Approximate Retail Value ("ARV"): The one (1) Grand Prize winner will receive a USD $1,000 (approximately CAD $996.50) Disney Store Bonus Shopping Card. Disney Store Bonus Shopping Cards are redeemable online at www.disneystore.com or at participating Disney Store retail locations throughout the US. Disney Store Bonus Shopping Cards are subject to the terms and conditions available at www.disneyterms.com/home/disney-terms/disneystorebonusshoppingcard.com. Disney Store Bonus Shopping Cards are denominated in United States Dollars. Disney Store Bonus Shopping Card cannot be transferred for value or redeemed for cash. Each Disney Store Bonus Shopping Card will not be replaced or replenished if it is lost, stolen, damaged, destroyed or used without the Grand Prize winner's permission and will be voided if altered or defaced. Only one (1) prize will be awarded in this Sweepstakes.
Odds of Winning and Winner Selection: The odds of winning the Grand Prize depend upon the number of eligible Entries received during the Sweepstakes Period. Administrator will randomly select the potential Sweepstakes Grand Prize winner from among all eligible Entries during the Sweepstakes Period, on or around December 13, 2012.
The potential Grand Prize winner will be notified at his/her Twitter account via Direct Message from @DisneySantaPaws and asked to provide his/her full name, e-mail address, Twitter account name, age and complete mailing address (collectively, "Contact Information") in an e-mail to Administrator's e-mail address as stated in the Direct Message ("Prize Notification"). The potential winner must reply via e-mail to Administrator's e-mail address as designated in the Prize Notification with entrant's Contact Information within 5 days from the date the Prize Notification is sent to the potential Grand Prize winner by the Administrator (the "Deadline"). Administrator and Sponsor will use such Contact Information for verification of entrant's eligibility, compliance with these Official Rules and Prize fulfillment purposes only. All Contact Information gathered will be subject to the Sponsor's Privacy Policy as further described in Section 15 below. The mailing address must be a complete and valid street address (P.O. boxes are not permitted) including city, state/province/territory and ZIP/postal code. Upon verification of entrant eligibility and compliance with these Official Rules (and, in the case of Canadian residents, successful completion of the time-limited skill testing question as further described in Section 11 below), Sponsor will mail the Prize to the winner. In the event the selected potential winner is found to be ineligible or not in compliance with these Official Rules, Sponsor and/or Administrator is unable to contact the potential winner, the potential winner does not reply to the Prize Notification before the Deadline in accordance with these Official Rules and the directions provided in the Prize Notification, or the Prize Notification or Grand Prize is returned as undeliverable, then the Grand Prize may be forfeited. In the event of forfeiture of the Grand Prize or in the event that a potential winner is disqualified for any reason, Sponsor will award the Grand Prize to an alternate potential Grand Prize winner by randomly drawing from among all remaining eligible Entries. In such cases where the Grand Prize is not accepted or where the Grand Prize is forfeited, there will, as necessary, be three (3) alternate drawings, after which the Grand Prize, if not accepted by an eligible winner, may not be awarded. For U.S. residents, the Grand Prize will be fulfilled 8-10 weeks following winner verification. For Canadian residents, the Grand Prize will be fulfilled the later of either 2-3 weeks after the receipt of the Grand Prize winner's skills test or 8-10 weeks following winner verification.
Grand Prize may not be declined once awarded to and accepted by the Grand Prize winner. Grand Prize may not be bartered, transferred, sold, or redeemed for cash value in whole or in part. The right to receive the Grand Prize is non-assignable, non-transferable and no substitution, exchange or cash equivalent will be allowed, except by Sponsor who reserves the right to substitute the Grand Prize with a prize of equal or greater value in case of unavailability of the Grand Prize or force majeure. Released Parties, as defined in Section 12 below, shall not be held responsible for any delays in awarding the Grand Prize for any reason. Grand Prize will only be awarded to a verified winner.
Sponsor, in its sole discretion, reserves the right to substitute the listed Grand Prize for one of equal or greater value if the Grand Prize should become unavailable for any reason or unreasonably difficult to fulfill. Noncompliance with any of the foregoing or any portion of these Official Rules may result in disqualification and awarding of the Grand Prize to an alternate winner. Federal, state, territorial, and local taxes and all other expenses not specified herein are winner's sole responsibility. If Grand Prize Winner is a U.S. resident, he/she will receive an IRS Form 1099 reflecting the value of the Grand Prize.
Canadian Residents Only: If the selected potential Grand Prize winner is from Canada, he/she will be required to correctly answer a time-limited skill testing question without any assistance in order to be eligible to receive the Grand Prize or such prize will be forfeited.
Limitations on Liability: Entrants (and, if a minor, his/her parent's or legal guardian's) agree that Sponsor, Administrator and their respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively "Released Parties") will have no liability whatsoever, and shall be held harmless by entrants, for any injuries, claims, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in this Sweepstakes, or entrant's failure to comply with the Official Rules. The Released Parties shall not be liable to the Grand Prize winner or any other person for failure to supply the Grand Prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond the Released Parties' control. The Released Parties are not responsible for illegible, lost, late, damaged, incomplete, misdirected, or stolen Entries; or for typographical or other errors in the offer or administration of this Sweepstakes, including but not limited to: errors in advertising, Rules, selection and announcement of the winner and distribution of the prize; or for lost, interrupted or unavailable network, server, satellite, Internet Service Provider (ISP), website or other connections, availability or accessibility; or for miscommunications, failed computer, telephone or cable transmissions, lines, or technical failure; or jumbled, corrupted, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties; or for any other errors of any kind whether human, mechanical, electronic, technical or network; or for the incorrect or inaccurate capture of entry or other information or the failure to capture any such information; or for any misdirection or delay of any e-mail to be received on account of technical problems or traffic congestion on the Internet or Twitter website, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from participation in or downloading or uploading any materials in connection with the Sweepstakes; or for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes; or for any personal injury, death, or damage to or loss of property, arising out of receipt or use or misuse of any prize produced and/or manufactured by a prize provider or other third party.
General Conditions: Persons who tamper with or abuse any aspect of the Sweepstakes as solely determined by the Sponsor, will be disqualified, and Sponsor reserves the right to terminate such entrant's eligibility. Sponsor may also disqualify any person that acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or for any other good cause reason solely determined by Sponsor. Should any portion of the Sweepstakes be, in Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes, and select winner from Entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. In the event of a dispute regarding prize claims or Entries received from multiple users having the same address, the authorized subscriber of the address at the time of entry used to enter, and not the name on the entry form, will be deemed to be the entrant and must comply with these rules. Authorized account subscriber is the natural person who is assigned the address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.
Except where legally prohibited, winner (and, if an eligible minor, his/her parent's or legal guardian's) grants (and agrees to confirm in writing) permission for the Released Parties to use his/her name, photograph, voice, likeness, and/or statements made by, or attributed to winner in all media now known or hereafter discovered, worldwide, including, without limitation, on the World Wide Web, without notice, review or approval or compensation. To claim the prize, the winner (or if a minor, minor's parent or legal guardian) will be required to sign and return to Administrator an Affidavit of Eligibility, Liability Release, and a Publicity Release (if winner is a Canadian resident, a Declaration of Compliance). within ten (10) days from the date the notice is sent to the potential Grand Prize winner.
Disputes/Choice of Law: Except where prohibited, entrant (and, if a minor, his/her parent's or legal guardian's) agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes (excluding any and all disputes, claims and cause of action arising out of or connected with the use of any of the prize awarded in the Sweepstakes) shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan, U.S.A.; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan, U.S.A.
