1.SPONSOR: Buena Vista Television, LLC, 500 South Buena Vista St., Burbank, CA 91521, is solely responsible for all aspects of this sweepstakes ("Sweepstakes").
2.ADMINISTRATOR: ESG, P.O. Box 7398, Burbank, CA 91510-7398, an independent judging organization whose decisions are final and binding as to all aspects of this Sweepstakes, but who is not the supplier or guarantor of any prizes.
3.DESCRIPTION: This Sweepstakes begins at 12:01 A.M., April 13, and ends at 11:59:59 P.M., May 31, 2011 ("Entry Period"). For purposes of these Official Rules ("Rules"), all times and days are Pacific Time and "Day" shall mean each calendar day during the Entry Period. Sponsor's computer shall be the official clock for purposes of this Sweepstakes.
4.ELIGIBILITY: Open only to persons 13 or older upon entry who are legal residents of, and physically located within, the 50 states or D.C. (collectively, "Territory") and who have either a valid social security number and/or a valid U.S. personal tax identification number. Employees of Sponsor, Administrator; their respective parent, subsidiary, affiliated and successor companies; the advertising, promotional and fulfillment agencies of each of them, (individually and collectively, "Entities"), members of their immediate families (parents, children, siblings, spouses) and persons living in the same households as such persons, whether related or not, are all ineligible to enter. If you are deemed a minor in your jurisdiction of residence ("Minor"), you must first obtain the consent of your parent/legal guardian ("Parent") to enter and all of your legal responsibilities under the Rules will be assumed by your Parent. If you are a Minor winner, the prize will be awarded in the name of your Parent for your benefit.
5.HOW TO ENTER: To enter this Sweepstakes, access the web site at www.Disney.com/TangledSweepstakes ( "Website"). If you are already registered on the Website, you must first login by entering your member name and password, then following the online instructions "submit" your entry information ("Entry"). If you are not yet registered on the Website, you may become a registered member for free by completing in full the registration form and thereafter transmitting it to the Sponsor.
6.LIMITATIONS: Entries must be received by 11:59:59 P.M., May 31, 2011. Limit one (1) Entry per person/email address ("Address") per Day. Proof of delivery or receipt of Entries will not be deemed by Sponsor as proof of Entry. In event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the person in whose name the Address is registered. Entries by any method other than set forth above in Section 5 are void. Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, "Releasees") are responsible for Entries from persons residing, or physically located, outside the Territory; Entries that are entered by other than human means (such as by an automated computer program or any non-human mechanism, entity or device), Entries in excess of the stated limits, or Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, illegible, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misdirected, multiple, mutilated, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Rules; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in your email account to receive email; or other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified and any attempt by a person to use multiple Addresses to register more than once may result in disqualification at Sponsor's sole discretion. Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations.
7.PRIZE: One (1) Grand Prize: A four (4) night cruise to the Bahamas and Nassau aboard the cruise ship, Disney Dream™, of the Disney Cruise Line® ("Cruise Line") for the winner and three (3) Guests ("Group"), consisting of the following elements for the Group ("Trip"): [1] if winner resides more than two hundred (200) miles from Port Canaveral, FL ("Port"), round-trip coach air transportation on a Sponsor-selected carrier between a Sponsor-selected gateway airport near winner's residence ("airport of origin") and Orlando International ("Airport"), provided If winner lives 200 miles or less from the Port (as determined by Sponsor in its sole discretion), Sponsor may substitute ground transportation from winner's residence directly to the Port for the air transportation and ground transportation portions of the prize, without additional compensation to the winner; [2] if winner resides more than 200 miles from Port, round-trip ground transportation between Airport and Port via Cruise Line transportation; [3] one (1) bedroom/stateroom Concierge Suite quadruple occupancy; [4] all onboard meals excluding alcoholic beverages and meals at Palo and Remy; [5] Government, Taxes, Fees and fuel surcharge (as defined in the Cruise Line website located at www.disneycruise.disney.go.com); [6] onboard gratuities for stateroom host/hostess, dining room server, assistant server and head server; [7] for the winner, one (1) $1,000 Disney Gift Card ("Card") that can be used at various participating Disney locations. All expenses not specifically mentioned herein are not included and are solely the winner's responsibility, including but not limited to: round trip transportation between the winner's residence and any airport of origin, alcoholic beverages, equipment rentals, gratuities and tips, insurance, laundry service, merchandise, parking, room service, service charges, ship to shore communications including the Internet, shore excursions, souvenirs, spa treatments, telephone calls and unspecified tips and grtuities. Airline carrier and Cruise Line regulations and conditions apply. Trip must be booked at least 45 days prior to intended travel dates and completed by June 30, 2012. Travel may not occur during the Cruise Line or airline blockout periods. Cruise Line block-out dates for 2011 are as follows and are subject to change: 7/1-7/29; 8/12; 11/23 and 12/18-12/22. If winner elects to take Trip with fewer than three (3) Guests, components of the prize will be awarded in increments/quantities suitable for the actual number of the Group and winner will not receive any compensation or substitute/alternate prize for same. Prize must be accepted with all listed prize components subject to the conditions indicated herein. Approximate Retail Value ("ARV"): $10,000, which will vary depending upon point of departure and seasonal fluctuation of cruise rates and airfares. Any difference between the ARV and the actual value will not be awarded to the winner. Any depiction of prize is for illustrative purposes only. Prize cannot be exchanged, redeemed for cash or transfered, except to a surviving spouse residing in the same household. No substitution allowed except, at Sponsor's sole discretion, a prize of equal or greater value may be substituted. The prize cannot be used in conjunction with any other promotion or offer. Once scheduled, Trip must be taken on dates and times arranged by Sponsor or prize will be forfeited in its entirety. Changes are not permitted after air ticket issue. Sponsor is not responsible for travel delays or cancellations. There shall be no compensation or prize substitution if any member of the Group is unable to take scheduled Trip by reason of illness, family emergency, personal events, terrorism, labor strikes, weather, or other acts beyond Sponsor's control. Gift Card ("Card") is subject to Terms and Conditions. For details visit http://disney.go.com/disneygiftcard/index.html. Card may not be resold in any manner whatsoever and may not be used toward the purchase of any Disney Dollars or gift certificates/cards. Card will not be replaced if lost or stolen. No credit card, credit line, overdraft protection or deposit account is associated with Card, nor may it be returned, redeemed or exchanged for cash, or used as payment on any Sponsor account except where required by law. No interest, dividends or any other earnings on funds deposited to Card will accrue or be paid or credited to you by Sponsor. The value associated with the Card is not insured by the Federal Deposit Insurance Corporation. Sponsor will not be responsible for any unauthorized transactions on the Card. Any fees associated with the Card are winner's sole responsibility. If, for any reason, a prize component is unavailable for some reason, then remaining elements of the prize shall constitute full satisfaction of Sponsor's prize obligation to winner and no additional compensation will be awarded. Winner notifications, applicable documents and prize components will be shipped to U.S. addresses only. The prize will be awarded provided it is validly claimed by August 1, 2011, after which no alternate winner will be selected, nor unclaimed prize awarded.
8.PROCEDURES, DRAWING, ODDS OF WINNING: All Entries must be received during the Entry Period. On or about June 14, 2011, in a random drawing conducted by the Administrator, the potential winner will be selected from all eligible Entries received. Odds of winning depend on the total number of eligible Entries received.
9.WINNER AND NOTIFICATION: Potential winner will be notified by email on or about June 19, 2011. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: [1] potential winner's failure to respond to notification within five (5) days after its transmission; [2] the return of an email notification as undeliverable after three (3) attempts; [3] potential winner's failure to provide Administrator with satisfactory proof of age, identity and residency; [4] potential winner's failure to execute and return an Affidavit of Eligibility/Liability/Publicity Release within five (5) days after receipt; [5] potential winner's failure to validly claim the prize by August 1, 2011; [6] potential winner's failure to be available to make the Trip and [7] any other non-compliance with Rules. Winner will be provided a FedEx account number for the return of all documents. In the event of a prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner. The Group must travel together on same itinerary; and a Minor may not participate in the Trip unless accompanied by his/her Parent as a member of the Group. If any member of the Group is pregnant and has entered her 24th week of pregnancy as of embarkation date, she will be refused passage due to safety concerns; and neither a physician's medical statement nor a waiver of liability will be accepted. Infant Guests must be older than 12 weeks to participate in the Trip. Each Guest will be required to complete, sign and notarize a Liability/Publicity Release and any other documentation Sponsor may require within five (5) days of winner's receipt in order to be eligible to accompany winner on Trip. Members of the Group are solely responsible for obtaining all necessary travel documents (valid photo I.D., credit card, passport, etc.) and must meet travel requirements of airline and Cruise Line (at Sponsor's sole discretion). The U.S. State Department requires that all members of the Group have a government issued passport for this Trip. For more information please visit the State Department's consular website www.travel.state.gov or the U.S. Department of Homeland Security's website www.dhs.gov. before departure. All taxes are solely the responsibility of the winner, who will receive an IRS Form 1099 reflecting the value of the prize.
10.PRIVACY POLICY AND DATA COLLECTION: Sponsor will not provide any personally identifying information of a Minor, regardless of its source, to any third party without the express written consent of Minor's Parent. All personal information provided by you for this Sweepstakes is subject to Sponsor's privacy policy located at http://disney.go.com/corporate/privacy/pp_wdig.html ("Privacy Policy").
11.GENERAL CONDITIONS: By entering this Sweepstakes and/or accepting any prize you may win, you agree that: [1] you will be bound by the Rules and the Sponsor's/Administrator's decisions, which shall be final in all respects; [2] the Entry becomes solely the Sponsor's property and will not be acknowledged or returned; [3] you release and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of the prize; participation in this Sweepstakes or any Sweepstakes-related activity or travel or from any interaction with, or downloading of, computer Sweepstakes information; [4] the Releasees do not make any representation, warranty or guarantee, express or implied, relating to this Sweepstakes or the prize; [5] winner's acceptance of the prize constitutes the grant to Sponsor and assigns of an unconditional right to use winner's name, address (city and state only), voice, likeness, photograph, biographical and prize information, statements about this Sweepstakes and/or live and taped performances of interviews for any programming, publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [6] in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor's reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of this Sweepstakes, so that it cannot be conducted as originally planned, except where prohibited by law, Sponsor has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate or suspend this Sweepstakes; and in such event, to select a winner by such method as Sponsor in its sole discretion shall consider equitable; and in the event the Trip has already commenced, to terminate the Trip and return the Group to any airport of origin as soon as reasonably possible; [7] the Releasees are not responsible for typographical or other errors in the offer or administration of this Sweepstakes, including but not limited to: errors in the advertising, Rules and selection and announcement of the winner; [8] any portion of the prize not accepted or used by the winner will be forfeited; [9] the Releasees are not responsible for any inability of the winner to accept or use the prize (or any portion thereof) for any reason; [10] the Sponsor has the right, at any time and at its sole discretion, to disqualify any individual it suspects to be doing any of the following: (a) tampering or attempting to tamper with the Entry process or the operation of this Sweepstakes; (b) violating the Rules; (c) violating the terms of service, privacy policy or other terms, conditions of use and/or general rules or guidelines of any Sweepstakes property or service; (d) acting in bad faith, in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or (e) for any other good cause as determined solely by the Sponsor; [11] since any attempt by any individual to deliberately undermine the legitimate operation of this Sweepstakes is a violation of these Rules as well as criminal and civil laws; and should Sponsor believe or become aware that such an attempt has been, is being, or will be made, it has the right to seek remedies and damages from any responsible individuals to the fullest extent permitted by law, including without limitation criminal prosecution and [12] Sponsor has the right to modify prize award procedures at its sole discretion.
12.GOVERNING LAW, JURISDICTION, ARBITRATION: Any controversy or claim arising out of or relating to (i) this Sweepstakes, (ii) the awarding or redemption of the prize and/or (iii) the determination of the scope or applicability of these Rules or their enforcement or interpretation shall be governed by and construed in accordance with the substantive laws of the State of California without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state's laws. Any controversy or claim arising out of or relating to this Agreement, its enforcement, arbitrability or interpretation shall be submitted to final and binding arbitration, to be held in Los Angeles County, California, before a single arbitrator, in accordance with California Code of Civil Procedure §§ 1280 et seq. The arbitrator shall be selected by mutual agreement of Sponsor and the entrant or entrants bringing forth the controversy or claim (collectively, the "Parties") or, if the Parties cannot agree, then by striking from a list of arbitrators supplied by the American Arbitration Association or JAMS/Endispute. The arbitration shall be a confidential proceeding, closed to the general public. The arbitrator shall issue a written opinion stating the essential findings and conclusions upon which the arbitrator's award is based. The Parties will share equally in payment of the arbitrator's fees and arbitration expenses and any other costs unique to the arbitration hearing (recognizing that each side bears its own deposition, witness, expert and attorneys' fees and other expenses to the same extent as if the matter were being heard in court). You agree that your claim will be resolved individually, exclusively by arbitration, without resort to any form of class action. You further agree that any claim/judgment/award in such arbitration shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Sweepstakes but in no event include attorneys' fees; and, under no circumstances, will you be entitled to awards for and you hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or increased. Should any term of this Section be deemed void, unenforceable or contrary to law, such term shall, but only to the extent necessary to bring this Section within the requirements of law, be deemed to be severed from the other terms of these Rules, and the remainder of these Rules shall be given effect as if it had not included the severed term herein. THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT, AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
