OFFICIAL RULES
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE
IMPROVE ONE'S CHANCES OF WINNING
1. SPONSOR: WDIG Mobile, L.L.C., 500 S. Buena Vista Street, Burbank, CA 91521.
2. ENTRY: You may enter this Sweepstakes only via the Internet, during each of the eleven (11) Monday--Sunday weeks ("Week"), commencing on Monday, February 27, and ending on Sunday, May 14, 2006 ("Term"). For purposes of these Official Rules ("Rules"), all times and dates are Pacific Time. Entry may only be accomplished as a registered member ("Member") of DisneyMobile.com ("Website"). If you are a Member, during the Term, log onto the Website and log in by providing your Member Name and Password. If you are not a Member, you may become a Member for free by visiting the Website and providing the requested information on the Registration Form through the link on the site: "Not registered?" Upon registration, or if you are already a Member, you may participate in the Sweepstakes by following the "How to Enter" instructions. Normal Internet access and usage charges imposed by your on-line service will apply. It is your sole responsibility to notify the Sponsor in writing if you change your e-mail address ("Address"). To do so, go to http://register.go.com/go/memberservices/home, log into your Website account with your Member Name and Password, click on "Modify" and follow the instructions on how to change your Address. The Sweepstakes will consist of eleven (11) separate random drawings, one after each Week ("Drawing") The entry period for each Drawing will be all Weeks preceding the Drawing.
3. LIMITATIONS: All entries for the first Drawing must be received by Sunday, March 5, 2006, and all entries for each subsequent Drawing must be received by the Sunday preceding that Drawing. All non-winning entries from earlier Drawings will be carried over to subsequent Drawings. All entries for the last Drawing must be received by May 14, 2006. Entries are limited to one entry per Member for the full Term. In event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the Address is registered. Entries by any method other than set forth above in Paragraph 2 are void. Any use of automated or programmed methods of effecting entry on-line is prohibited. Open only to persons who are at least 18 years of age upon entry, legal residents of, and physically located within, the 50 United States or D.C. ("Territory") and not employees of Sponsor, its parent, subsidiary or affiliated companies; or the advertising, promotional or fulfillment agencies of any of them (individually and collectively, "Entities"); nor members of their households or immediate families, and with Internet access as of February 26, 2006. Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, "Releasees") are responsible for entries from persons residing, or physically located, outside the Territory; entries that are altered, defective, delayed, deleted, destroyed, failed, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, invalid, late, lost, misrouted, multiple, non-delivered, stolen, tampered with, unauthorized or unintelligible; inaccurate or incomplete capture online of Sweepstakes entry information; for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; printing errors; production errors; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable e-mails resulting from any form of active or passive e-mail filtering; insufficient space in entrant's e-mail account to receive e-mail; or other errors of any kind, whether due to electronic, mechanical or human error or other causes; even if caused by the negligence of any of the Releasees. Each of such potential entries will be disqualified. Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations.
4. PRIZES: TWELVE (12) GRAND PRIZES (one for each of the first ten (10) Drawings and two for the last Drawing): Each Grand Prize will consist of a pair of Disney Mobile phone hand sets (approximate retail value ("ARV"): $260) plus an $80 per month service plan for twelve (12) months (ARV: $960). (ARV of each Grand Prize: $1,220). Total ARV of all prizes: $14,640. All expenses not specifically mentioned herein are not included and are solely the winner's responsibility, including but not limited to: additional phone handsets, a Subscriber Plan above and beyond the $80.00 service plan and insurance. Sponsor will not replace any lost or stolen prize items. Limit one (1) prize per Member/household/Address.
5. PROCEDURES: Sweepstakes begins February 27, and ends May 14, 2006. Under the Sponsor's supervision, eleven (11) random Drawings will be conducted, one each Monday to select the winner or winners for the preceding Week from all eligible entries received up to the end of that Week. There will be one (1) winner for each of the first ten (10) Drawings and two (2) winners for the last Drawing. Odds of winning for each winner of a Drawing depend on the total number of eligible entries received during all Weeks preceding that Drawing as reduced by the number of winners for all preceding Drawings. For each Drawing there is a carry-over of all non-winning entries from all preceding Drawings.
6. WINNERS: Each potential winner for a Drawing will be notified by e-mail, postal mail or telephone on or about the Tuesday following that Drawing. All prizes will be delivered on or about July 10, 2006. Disqualification and the selection of an alternate winner may result from any of the following: [1] potential winner's failure to respond to notification within five (5) days after its transmission; [2] the return of an e-mail notification as undeliverable after three (3) attempts; [3] the return of any other notice or a prize as undeliverable; [4] potential winner's failure to execute and return an Affidavit of Eligibility/Liability/Publicity Release within five (5) days after its transmission; [5] potential winner's failure to sign the standard WDIG Mobile, LLC Subscriber Agreement and Terms and Conditions [6] potential winner's failure to provide Sponsor with satisfactory proof that he/she is the authorized account holder of the Address associated with the winning entry; [7] potential winner's failure to claim a prize within ten (10) days after it is sent and [8] any other non-compliance with Rules. All taxes are solely the responsibility of each winner, who will receive an IRS Form 1099 reflecting the prize value. Potential winners' will be posted each Week on the Website. 7. CONDITIONS: Each entrant by entering this Sweepstakes agrees that: [1] he/she will abide by and be bound by the Rules and Sponsor's decisions; [2] the entry becomes solely the Sponsor's property and will not be acknowledged; [3] the Releasees are not responsible for claims, injuries, losses or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in this Sweepstakes or in any activity or travel related thereto or from computer downloading any Sweepstakes information; [4] winner's acceptance of any prize constitutes the grant of an unconditional right to use winner's name, address (city and state only), voice, likeness, photograph, biographical and prize information and/or statements about the promotion for any publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [5] in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor's reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of this Sweepstakes, so that it cannot be conducted as originally planned, the Sponsor has the right to cancel, terminate or suspend the Sweepstakes; and in such event, to select winners by random drawing from among all eligible entries received up to such time of cancellation, termination or suspension; [6] the Releasees are not responsible for typographical or other errors in the offer or administration of this Sweepstakes, including but not limited to: errors in the advertising, Rules, selection and announcement of the winners and distribution of the prizes; [7] any part of any prize not accepted or used by any winner will be forfeited; [8] the Releasees are not responsible for any inability of any winner to accept or use any prize (or any portion thereof) for any reason; [9] Sponsor has the right to disqualify any individual found to be: (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or the Website; (b) violating the Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Sweepstakes property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; [10] Sponsor has the right to lock out an entrant whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter the Sweepstakes; [11] since any attempt by an entrant or any other individual to deliberately alter or damage the Website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws, Sponsor shall have the right to seek damages from any such entrant to the fullest extent permitted by law; and [12] any dispute that arises regarding the meaning or interpretation of the Rules shall be resolved by applying the laws of California in an action brought in the state or federal courts located within that state.
